                    SP Legacy Assurance Terms and Conditions

 

These Terms and Conditions ("Agreement") govern the use of services provided by SP Legacy Assurance ("Service Provider") to the undersigned client ("Client"). By using our services, the Client agrees to the following detailed terms and conditions:

1. Scope of Services

The Service Provider will assist the Client in preparing and completing their will based on the information provided by the Client. The Service Provider will provide general information and guidance on how to fill out the will forms but will not offer legal advice or interpret the law. The Service Provider’s role is limited to document preparation and guidance, and the Client should seek the advice of a licensed attorney for any legal questions or complex issues related to their will or estate planning.

2. No Legal Advice

The Client acknowledges that the Service Provider is not a licensed attorney and cannot provide legal advice. Any information provided by the Service Provider should not be construed as legal advice, and the Client should seek the advice of a licensed attorney for any legal questions or complex issues.

3. Disclosure

The Client understands that the Service Provider is a Legal Document Assistant (LDA) and Notary in the State of Washington. A written disclosure stating that the Service Provider is not an attorney and cannot provide legal advice will be provided to the Client and must be acknowledged by the Client before any services are rendered.

4. Document Preparation and Execution

The Service Provider will assist the Client in filling out standard will forms based on the information provided by the Client. The Client is responsible for ensuring that the will is executed properly according to Washington State laws, including obtaining the required witnesses' signatures. The Client acknowledges that improper execution of the will may result in its invalidity.

5. Notarization

The Service Provider may notarize the self-proving affidavit attached to the will, if requested by the Client. Notarization is not legally required for the validity of the will but can facilitate the probate process. The Client acknowledges that notarization services provided by the Service Provider are limited to notarizing documents related to the will preparation process.

6. Confidentiality

The Service Provider will maintain the confidentiality of all personal information provided by the Client. The Service Provider will safeguard any documents and information related to the will preparation. However, the Client acknowledges that electronic communications and online storage are not completely secure and agrees to hold the Service Provider harmless for any unauthorized access to such information.

7. Ethical Standards

The Service Provider will adhere to high ethical standards and avoid any conflicts of interest. The Service Provider will not prepare a will in which they or their close family members are named as beneficiaries. The Client agrees to disclose any potential conflicts of interest to the Service Provider.

8. Client Responsibilities

The Client agrees to provide accurate and complete information for the preparation of their will. The Client understands that the Service Provider's role is limited to document preparation and guidance. The Client is responsible for reviewing the will for accuracy and completeness before signing. The Client acknowledges that errors or omissions in the information provided may affect the validity of the will.

9. Legal Updates

The Service Provider will make reasonable efforts to stay informed about changes in Washington State laws related to will preparation and notary services. The Client acknowledges that laws may change, and it is their responsibility to seek updated legal advice as needed. The Service Provider is not liable for any changes in law that may affect the validity or effectiveness of the will.

10. Fees and Payments

The Client agrees to pay the fees for the will preparation services as outlined on the Service Provider's website or in any provided fee schedule. The Service Provider’s $35 traveling fee is non-refundable but allows for rescheduling if necessary. Payment is due at the time services are rendered, unless otherwise agreed upon in writing. The Client acknowledges that failure to pay fees may result in the withholding of completed documents.

11. Limitation of Liability

The Service Provider's liability is limited to the amount paid by the Client for the will preparation services. The Service Provider is not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the services provided. The Client agrees to indemnify and hold harmless the Service Provider from any claims, damages, or expenses arising out of the Client's use of the services.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes arising out of or relating to this Agreement shall be resolved in the courts of Washington State.

13. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings, agreements, representations, and warranties, whether written or oral, with respect to the subject matter hereof. Any modifications to this Agreement must be in writing and signed by both parties.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.

15. Termination

Either party may terminate this Agreement with written notice to the other party. Upon termination, the Client shall pay for any services rendered up to the date of termination. The Service Provider may retain copies of any documents prepared for the Client.

16. Acceptance

By using the Service Provider’s services, the Client agrees to these Terms and Conditions in their entirety. If the Client does not agree to these Terms and Conditions, they must not use the Service Provider’s services.
